Schedule for January 26 Combined Zoning and Business Meeting

As approved by City Council on November 24, 2008, the January 26 Council meeting will be a combined Zoning and Business Meeting. The schedule begins with the Dinner Briefing in CMGC #267 at 5:00 p.m. The Zoning Meeting will begin at 6:00 p.m. in the Council Chamber with the Business Meeting immediately following beginning with the Citizens' Forum.

Zoning agenda books were distributed by staff last week. Business agendas are included in today's packet.


Feb. 5: Elected Officials Meeting and Public Meeting for Interstate 85/Interstate 485 Interchange in Northeast Charlotte

Staff from the North Carolina Department of Transportation (NCDOT) will host an elected officials meeting and a public meeting about the Interstate 85/Interstate 485 interchange in northeast Charlotte near Concord Mills Mall on Thursday, February 5 in the Mallard Creek High School cafeteria, 3825 Johnston-Oehler Road.

The local elected officials meeting will be held from 4:30 p.m. until 5:00 p.m. and will provide elected officials with an opportunity to receive input, ask questions, and voice concerns about the project. The public meeting will be held from 5:00 p.m. until 8:00 p.m. While formal presentations will not be made during the public meeting, the format will allow citizens to talk with staff in an informal setting to ask questions and provide comments related to the reconstruction of the existing interchange that will be done once Interstate 485 is built between NC 115 and Interstate 85.

While these meetings will focus primarily on the Interstate 85/Interstate 485 interchange, NCDOT staff will have information available for review regarding the unbuilt portion of Interstate 485 between NC 115 and Interstate 85.

Scaleybark Station TOD Project – Agreement with Scaleybark Partners

Pappas Properties has notified the City of its need to amend the Agreement, citing economic conditions and turmoil in the capital markets. The modifications proposed by Pappas affect the timing of payments due to the City and the commencement of construction of certain improvements required in the existing Agreement with the City.

Though Pappas' request includes a reduction in the payment due on February 28, 2009 from $3,324,500.00 to $2,200,000.00, that amount will still fulfill the City/CATS obligation to the FTA under the Full Funding Grant Agreement - a threshold requirement given the sale of CATS' property to Pappas as part of this transaction. Given the proposed reduction in the February 2009 payment, the payment due on February 28, 2010 will increase from $463,500.00 to $1,588,000.00, thus delaying the payment of $1,124,500 by one year. In terms of construction, Pappas has proposed that three elements be postponed: commencement of construction of streetscape improvements; commencement of construction of the linear park; and commencement of marketing expenditures. Staff has met with Pappas Properties and is negotiating the specific timelines for these three activities.

Staff is evaluating the impact of this request, including any cost of capital impacts and what remedies are available to mitigate impacts.

Staff will submit a Request for Council Action reflecting its findings and recommendations prior to the current payment due date of February 28, 2009.


Solid Waste Services Collection Update

Residential collection services were suspended on Tuesday, January 20 due to hazardous neighborhood road conditions that did not improve until mid-afternoon. Solid Waste Services was already operating on a one-day delay due to the observance of the Martin Luther King Jr. Holiday. In order to get collection services back on schedule, the department is temporarily suspending yard waste collection, bulky item collection, and recycling collection during the week of January 19 and diverting manpower and equipment to perform garbage collection. Customers who normally receive garbage collection service on Monday or Tuesday will receive garbage collection on Wednesday. Wednesday customers will be serviced on Thursday; Thursday customers will be serviced on Friday; and, Friday customers will receive garbage collection service on Saturday, January 24.

Solid Waste Services is making every effort to promptly return to normal collection schedules. However, because of the two-day delay, there will likely be isolated incomplete garbage collection routes in the short term. Where that occurs, all affected customers will be serviced as soon as possible the following day.

As garbage collection service returns to normal later this week, crews will begin collecting recycling materials. It is undetermined at this point precisely when that may occur. Bulky materials that were scheduled for collection during the week of January 19 will be collected during the week of January 26. Bulky materials scheduled for collection during the week of January 26 will receive collection as originally scheduled. Yard waste collection will not occur during the week of January 19 but will resume under regular service schedules on Monday, January 26.

Solid Waste Services will issue daily updates until normal service schedules are restored.
