Release of Deed Restrictions from Mecklenburg County Park & Recreation Properties

The January 12 Council agenda includes a request to release deed restrictions and a utility easement from County-owned property to allow the construction of a Mecklenburg County/CPCC parking deck at the corner of Seventh Street and Charlottetown Avenue (map attached).

The deck will be utilized by CPCC for student parking and by the County to serve Memorial Stadium, Grady Cole Center and Independence Park. The deck will also include 4,000 SF of office and storage space for the County and CPCC. Adjacent improvements will include a landscaped and lighted greenway connection from Independence Park behind the parking deck and Memorial Stadium. The County will finance the deck with Certificates of Participation (COPs) that were approved by the Board on July 10, 2007.

Plans for the deck have been reviewed and approved by the Planning Commission and by the Charlotte Mecklenburg Historic Landmarks Commission for a "certificate of appropriateness".

The property (a portion of tax parcel 080-171-01 and entire tax parcel 080-171-02) was transferred from the City to the County as part of the 1992 Park and Recreation Consolidation Agreement with stipulations that the property revert to City control if it ceases to be used for park purposes. The County has requested that these restrictions, plus a utility easement, be removed by the City from the entire parcel 080-171-02 and from a portion of parcel 080-171-01. The larger remainder portion of parcel 080-171-01 houses Memorial Stadium and the Grady Cole Center, and the restrictions will not be released from that larger portion. The County's legal counsel has determined that the removal of these restrictions is sufficient for the County's purposes in pursuing funding and building the structure.
