Council Manager Memo #9 - January 30, 2008

P & L Coliseum, L. P. (Pope & Land) desires to purchase 5.557 acres of vacant City-owned property (a portion of Tax Parcel I.D. No. 143-133-01) located on Tyvola Road across from Paul Buck Boulevard for $150,000 per acre (subject to due diligence) which was the fair market value of the former Coliseum property, for a mixed use development of approximately 50,000 square feet.
 
The above mentioned property went through the mandatory referral process on March 7, 2007. The Planning Committee recommended the sale of the surplus property with no other KBU expressing a need for the property.
 
In accordance with the "Upset Bid" process (G.S. 160A-269 et al) the Real Estate Division will advertise the "Notice of Offer" from Pope & Land to be published in the local newspaper containing a general description of the property and the amount and terms of the offer. Within ten days of the ad's first appearance, any person may raise the bid/offer received by the City of Charlotte by not less than ten percent of the first one thousand dollars of the offer and five percent of the remainder.
 
In the event a qualifying upset bid/offer is received, a new "Notice of Offer" shall be published, advertising the terms and amount of the increased bid. This procedure shall be repeated until no further qualifying upset bids are received. Upon completion of the upset bid process, the successful bidder shall have ten calendar days in which to sign a binding contract, subject to final approval of the Council.
 
Staff will bring to Council the successful bidder and request the approval of a resolution
authorizing the sale of 5.557 acres on Tyvola Road and authorizing the City Manager to
execute the necessary documents and deed between the City of Charlotte and the buyer.
Below is additional background about the sale of this property.
 
The purchaser and developer of the coliseum property, Pope & Land Enterprises, Inc., has expressed interest in purchasing this property as part of the assemblage of the Coliseum property. The property, located at the intersection of West Tyvola Road and Paul Buck Boulevard is currently vacant and will be used to develop retail at the entrance to their development, City Park. The property has been rezoned to allow this use. The new retail will be incorporated into the master plan for the new City Park development. After disposal from City inventory, the parcel will generate property taxes on an otherwise dormant piece of property.   
 
 
Workshop for State Transportation Improvement Project

The North Carolina Department of Transportation (NCDOT) along with Charlotte Area Transit System (CATS) will hold a Citizens Informational Workshop for State Transportation Improvement Project U-209B.  This project will widen Independence Boulevard (US 74) from Albemarle Road to Conference Drive.  Grade separated interchanges will be constructed at Sharon Amity Road and Idlewild Road.  A bridge over Independence Boulevard will be provided for Conference Drive.  Additionally, the project will extend the existing busway from Sharon Amity Road to Conference Drive.
 
NCDOT and CATS are working cooperatively as a result of an agreement to provide a coordinated plan for future highway and transit improvements in the Southeast Corridor.  The workshop will show the design for the project as part of the completion of a Reevaluation of the Final Supplemental Environmental Impact Statement (FSEIS).  It is anticipated the FSEIS will be approved in April 2008.  NCDOT will begin right-of-way acquisition in December 2008 and construction by January 2011.   
 
The workshop is a drop-in session and will be held February 12, 2008 in the Eastland Mall Activity Room from 4:00 pm to 8:00 pm.
 
 
Wallace Farm Update

This is to update Council on the status of the State permitting processes for the Wallace Farm composting operations, 14410 Eastfield Road.  The major regulatory authority for the farm's operations rests with the State, with Mecklenburg County acting as the State's enforcement agent. 
 
The review of Wallace's application to renew its State Division of Waste Management (DWM) permit has been on hold pending action by the State Division of Water Quality (DWQ).  Staff has learned that Wallace Farm submitted a stormwater permit application to the DWQ on January 25. The submittal triggers DWQ review, estimated to take approximately three months, including a 30 day public notice and comment period.  Upon completion of the stormwater permit process, and subsequent review of any impact on waste management requirements, DWM staff has indicated they will schedule a public hearing in Charlotte on the draft solid waste permit. 
 
Mecklenburg County Solid Waste staff investigates odors on a complaint basis to determine if a formal Notice of Violation is warranted based on the State Solid Waste Management Rules.    
 
We will continue to keep Council advised of any new developments, including opportunities for public comments to the State once they are scheduled.
 
 
Housing Trust Fund Advisory Board

On December 13, 2007, the Housing Trust Fund Advisory Board held its annual elections and appointed new officers for the positions of Chair and Vice Chair.  Mr. Bobby Drakeford was elected Chair and Ms. Tylee Kessler was elected Vice Chair.  The Housing Trust Fund was established by City Council in 2001 to provide financing for affordable housing. 
 
The Advisory Board was established to oversee operations and develop policies for the administration of the Housing Trust Fund.  The current members of the Advisory Board are listed below:
Bobby Drakeford     
Mr. Drakeford is serving as the current Chair of the Advisory Board and Chair   he is serving in his second year as a member of the Board.  He is the Founder and President of The Drakeford Company, a residential real estate development company emphasizing condominium and single family home construction.
 
Tylee Kessler             
Ms. Kessler is serving as the Vice Chair and is employed as a Senior Vice Chair Development Officer with the Charlotte Housing Authority, where she is responsible for managing and implementing real estate financing and development initiatives.  She is serving in her first term on the Advisory Board.
 
Rickey Hall     
Mr. Hall is a Special Assistant for Housing with the Mecklenburg County Department of Social Services.  Mr. Hall is a former member of the Charlotte Housing Authority's Board of Commissioners and a community activist in support of affordable housing.  He is an original member of the Advisory Board and has served for six years.
 
Drew Jones      
Mr. Jones is a Senior Vice President of Customer Care for Lending Tree, LLC, growing the company's call center operation, which includes locations in Charlotte, Irvine, California and Bloomingdale. He is serving in his second year as a member of the Advisory Board.
 
T. Anthony Lindsey 
Mr. Lindsey is President and Chief Executive Officer of Globe Crossing LLC., a real estate and mortgage corporation. Mr. Lindsey is an original member of the Advisory Board and has served for six years. He has served the last two years as the Chair of the Board.
 
Eric Montgomery   
Mr. Montgomery is Assistant General Counsel with Bank of America.  He is responsible for providing legal services within the bank with emphasis.  in the areas of employment and labor law. He is serving in his first term as a member of the Advisory Board.
 
Paul Woollard    
Mr. Woollard is the Executive Director of the Affordable Housing Group, an organization providing development and technical assistance for affordable housing developers.  He is an original member of the Advisory Board and has served for six years. He was the first Chair of the Board and served in that capacity for two terms.
