On April 8, 2008 a notice of violation was sent to the owner of Queen City Smokes notifying them of the requirement to obtain a Change of Use permit in order to operate a business with a residence at this location, which had previously been used as an office (both uses are allowed in the B-2 Zoning District, but to change from one use to the other requires a change of use permit and various site improvements). The deadline for submitting plans for review was May 8, 2008.
The owner failed to submit plans and staff has issued three citations of increasing value. The third citation was delivered on May 22, 2008 and the owner notified staff that the business is closed. A sign was posted on the door and the business was locked. Staff is awaiting a letter from Ms. Taylor to that effect.
The zoning violation no longer exists at this location.
TCC Recommendations Regarding 2009-2015 Transportation Improvement Program (TIP) Amendment

Motorists are attempting to avoid the congestion on US 74 by using NC 218 as a bypass of Monroe. As a result, the road is severely deteriorating and routine maintenance is no longer able to keep the road in an acceptable condition. NCDOT's plan is to spend approximately $15 million to resurface the road, add 1.5 feet of pavement to each side and to add turn lanes at NC 200, NC 205 and US 601.
The NCDOT recommended funding to come from the delay of the Polkton bypass (R-3820) in Anson County and from cost savings from the Graham Street Extension/Mallard Creek Road Realignment (U-2507A) project in Charlotte.
The Technical Coordinating Committee (TCC) made a motion on June 5 to accept the financial strategy to fund the NC 218 improvements provided that:
- the City of Charlotte staff assures the TCC that the U-2507A cost estimate reflects the City's vision for the project's design;
- the Charlotte City Council agrees with the proposed strategy; and
- no other project be delayed as a result of the funding of NC 218
The TCC voted unanimously to recommend to the MUMPO Board that it amend the TIP to reflect this funding strategy.
The MUMPO will be asked to approve the TIP amendment at their July 16 meeting. Staff will be asking City Council to direct its MUMPO representative's vote to support this TIP amendment as recommended by the TCC.
