At the Council dinner on Monday evening, staff will discuss the Clean Air Works! pilot program, partially funded by Congestion Mitigation for Air Quality funds, and options for future allocation of Congestion Mitigation for Air Quality funds. Attached is the final report on the results of Clean Air Works!, prepared by the County's consultant, URS.

As part of the Provincetowne Storm Water flood control project, located off of Ballantyne Commons Parkway, property owners within the Williamsburg Neighborhood requested to cost-share with Storm Water Services to upgrade their roadside ditch system to a curb and gutter system. Through a formal petition process with 75% signatures in 1998, the Williamsburg Neighborhood property owners requested City Council to approve the cost-share arrangement following North Carolina General Statutes §160A-216 et seq. authorizing cities to make special assessments for such purposes.
On March 22, 1999, City Council approved an Assessment Resolution directing Storm Water Services to include into the Provincetowne Storm Water Project upgrades to a curb and gutter drainage system within the Williamsburg neighborhood. The resolution also stated the intention to levy special assessments on the 182 properties directly abutting the improvements once construction is completed to cover the $853,000 cost-share.
Construction has been completed and final project costs determined. To complete the assessment process, following the procedural requirements of the State Statute, Council will be asked to pass a resolution setting a public hearing for January 8, 2007, declaring cost, and ordering preparation and publication of the Preliminary Assessment Roll. This action is on the December 11, 2006 Council agenda.
Following the public hearing, Council will be asked to confirm the Assessment Roll.
Once approved, the City Finance Office will issue bills for payment and liens will be filed. Payments may be made in full or over 10 years with 8% interest. More information is provided in the meeting agenda. The December 11th dinner briefing includes a presentation on this item.

On December 11, 2006, City Council will be asked to approve a change order for the Clanton Road Pedestrian Safety Project in the amount of $129,995.25.
The Clanton Road Pedestrian Safety Project changes Clanton Road from a 4 lane, predominantly auto oriented street to a more complete street with two through lanes, left turn lanes, pedestrian refuge islands and bike lanes.
City Council approved the construction contract on September 25, 2006, in the amount of $408,960.00. The Contractor started work on October 4, 2006, with a 60-day completion time. During the milling, the base was exposed and extensive unanticipated subgrade failures were discovered. Staff directed the contractor to proceed with the subgrade repairs before securing Council approval for a change order for the following reasons:
- Delaying the repairs would have resulted in additional road repairs due to exposure to rain and traffic.
- Delaying the work would have suspended the contractor's operations and resulted in additional re-mobilization and traffic control costs.
- Delaying the work would have resulted in additional inconvenience to the traveling public and the neighborhood.
- Delaying the work may have resulted in the project not being able to be completed until spring. Contractually, paving season ends December 15.
The repair of the failed subgrade accounts amounts to about 70% of the change order. The remaining 30% is for additional quantities of curb and gutter, subsurface drainage and planting mix. Staff underestimated by about 11% of the original contract amount the quantity of needed curb and gutter, subsurface drainage and planting mix.
The project was substantially complete November 10, 2006, approximately 40% ahead of schedule.
Engineering & Property Management and CDOT staff identified additional funding for the change order to come from the Clanton Road project, Traffic Calming Program, Bicycle Program and Pedestrian Safety Program.

Solid Waste Services Yard Waste Collection Update

Solid Waste Services yard waste crews continue to make progress in clearing the substantial amount of yard waste that has accumulated during the fall leaf season. Currently, the North and West collection zones are on schedule. Solid Waste Services anticipates all zones to be back on schedule by the end of the next work week.
- Since Saturday, December 2, 2006 thru Tuesday, December 5, 2006, a total of 1,279 tons of yard waste has been collected. Approximately 866 tons were collected this past weekend by City employees with assistance from contracted Allied Waste crews. An additional 413 tons were collected from the Monday and Tuesday zones.
- Mecklenburg County has agreed to permit the City to deliver 50 truckloads per day for the next 4-5 business days without debagging at the curb. Due to high volume debagging at the curb has severely hampered our progress on the routes. Not having to debag will increase productivity and enhance our ability to resume a regular schedule by the end of the next work week.
- Although the crews continue to collect a substantial amount of yard waste from the curb, there is still a significant volume of yard waste left for collection, primarily in the South and East zones. Solid Waste Services will continue operating all available City yard waste collection crews and continue to supplement City crews with three contracted crews.
- An assessment will be made at the end of this week to determine if weekend work is necessary. If it is, Solid Waste Services will look at contracting collection through the weekend to provide relief for City crews.
Victory Christian Emergency Shelter for 50 Women

Planning Department staff has been working with plan reviewers in City Engineering, City Fire and County LUESA to determine if an emergency shelter for 50 women in the Seversville neighborhood is a permitted use. The shelter is proposed near the intersection of West Trade Street and Bruns Avenue. On November 21, a zoning interpretation was issued by the Zoning Administrator determining that the proposed emergency shelter is permitted. The interpretation also stated that emergency shelters could operate between November 5 and April 2. These dates correspond to the average first and last freeze dates in the Charlotte area according to the North Carolina Cooperative Extension Service. This corresponds to the Zoning Ordinance requirement that emergency shelters operate during times of extreme temperature.
Planning staff also arranged a meeting for Council member Mitchell to meet with Pastor Gool of Victory Christian Ministries on November 29. The purpose of the meeting was to further explain the operation of the facility and determine if the church had done any outreach to neighborhood leaders. Victory Christian representatives indicated no outreach had been done but agreed to meet with community leaders to respond to any issues or concerns about the facility. Pastor Gool indicated that Victory Christian was partnering with the Salvation Army to screen and refer clients to this facility.
Plans have been resubmitted to LUESA by Victory Christian addressing comments from City Engineering Zoning Plans Reviewers and City Fire Plans Reviewers. Each agency has reviewed the revised plans and has deemed them acceptable for approval. Issuance of permits should occur on or by December 8, 2006.

Charlotte Thunder Road Marathon - Saturday, December 9

The second annual Thunder Road Marathon will be held this Saturday, December 9. Expected attendance will be twice as large as last year with 1500-2000 runners. The race will start at 8 am Uptown between 6th and 7th Streets and continue through the Eastover, Foxcroft, Myers Park, Dilworth, South End, Wilmore, Gateway, NoDa, and Plaza Midwood neighborhoods before concluding on 2nd
Street close to the Convention Center. The route map and timeline are attached.
Preparation for this run began shortly after the event last year. All affected neighborhood associations and businesses have been briefed. City staff conducted a meeting with the event promoters and a representative from The Charlotte Observer to promote the event. Information on the event will be broadcast on the Government Channel. Race delay signs have been posted along the route. Also, the Geo-Notify System will provide telephone notification to individual households.
Smoking at the Airport
