Agenda Item #13: Rezoning Petition #2006-96

Petition 2006-96 seeks to rezone 41.19 acres located on the west side of McCullough Drive, south of W.T. Harris Boulevard, to neighborhood services (NS). The current site plan allows up to 900,000 square feet of office uses, 30,000 square feet of commercial uses and a hotel on the site. The proposed rezoning seeks to incorporate up to 400 residential dwelling units, to reduce the amount of office to 200,000 square feet and retain the existing commercial uses and hotel.
The petitioner has worked closely with Council member Michael Barnes and several Northeast resident leaders to include a number of design and architectural commitments to the proposed petition. As a result, the petitioner has made the following additions and modifications to the rezoning plan after the Zoning Committee recommendation:
- Enhanced architectural and design commitments regarding the residential component of the mixed use community;
- Elimination of the tree save/view corridor areas along I-85 requested previously by the petitioner and approved by the Zoning Committee;
- Provision to permit a second hotel, upon the reduction of 35,000 square feet of retail/restaurant uses and free-standing retail/restaurant buildings; and
- In order to address certain technical matters, reclassification of portions of the site from the requested NS district to O-2(CD) and B-2(CD), as permitted by the Zoning Ordinance.
These additions are supported by the Planning Staff.
Since these changes are occurring after the Zoning Committee has rendered a recommendation, the City Council must vote on whether a new Zoning Committee recommendation is needed for the aforementioned modifications to the rezoning plan.

Concord/Kannapolis Interbasin Transfer Update

The N.C. Department of Environment & Natural Resources will hold a public meeting Tuesday, September 19, at 6 pm at Olympic High School to gather public comment on an Inter-Basin Transer (IBT) request by Concord and Kannapolis. The two cities seek permission to withdraw up to 22 million gallons per day from the Catawba and Yadkin river basins and transfer it to the Rocky River basin.
The City Council has previously been briefed on this issue. The state uses a rigorous modeling process to evaluate requests for IBT certificates. This is the same extensive process that Charlotte-Mecklenburg experienced when we applied for an IBT and received ours in 2002. Our continuing recommendation at this time is to allow the Concord/Kannapolis IBT request to proceed without taking a position.
Our understanding of the current NCDENR model is that the amount requested by Concord/Kannapolis would not have an impact on the quantity of water in the Catawba River for other cities. We will continue to monitor this process. Should the model data at some future point indicate the requested amount would have a negative impact on the Charlotte-Mecklenburg system, we will provide an additional briefing to Council.
Brevard Corridor Planning Study Public Meeting - September 21

The first of three public meetings to plan the future development in the Brevard Corridor between the Arena and the future NASCAR Hall of Fame will be held at 6:00 pm, Thursday, September 21, in room 267 of the Government Center. Environmental Excellence in Industry Luncheon

The Mayor and Council members are invited to attend a luncheon on October 4, 2006 from 11:30 am to 1:30 pm at the North Mecklenburg Water Treatment Plant. The Environmental Management System Protection Division will recognize the 2005 winners for the Charlotte-Mecklenburg Utilities Award for Environmental Excellence in Industry. This award is in recognition of the environmental stewardship demonstrated by industrial businesses. This is the ninth year Utilities has given this award. These businesses will also be acknowledged in The Charlotte Observer and The Business Journal. Please RSVP to Yer Lee at 704-391-5143 by September 22.
Street Selection Process for Resurfacing

Council member Foxx recently asked Charlotte Department of Transportation (CDOT) Director Jim Humphrey for some information on our resurfacing contract, particularly how we select streets. Attached is information prepared by Layton Lamb of the Street Maintenance Division of CDOT, including a description of our evaluation/selection methodology and streets in the FY 06 contract.
Streets are selected based upon a technical evaluation conducted by an outside consultant every year. Street Maintenance staff apply their knowledge of other circumstances, such as the schedule for construction of capital, developer or Charlotte Mecklenburg Utilities projects, and make judgments regarding whether to resurface one block or several in making the final choices.
Staff will be asking City Council to approve a change order to the FY 06 contract soon. The change order will keep us from deleting streets due to higher asphalt prices and add a few streets that need to be resurfaced right away due to changing circumstances.
Scaleybark Transit Oriented Development RFP Update

Staff has received the response to the Request for Proposals (RFP) for the City and CATS owned property in the Scaleybark Station area. This approximately 17 acre site is intended to be redeveloped for a mixed-use and mixed-income transit oriented development (TOD).
The three proposals received were from (1) Pappas Properties/The Housing Partnership/GreenHawk Partners, (2) McCormack Baron & Salazar/Neighboring Concepts/Crosland, and (3) Banc of America Community Development Corporation/Boulevard Centro/Harris Murr & Vermillion. All proposals include the following items:
- A vision for creating a dynamic transit oriented development
- Affordable housing component
- Financial explanations and capabilities
- SBE participation
- Implementation strategy
- Operation and management strategy
A staff team from Economic Development, Planning, CATS, Neighborhood Development, Engineering, and CDOT has already met to review the proposals. Moving forward, staff will present the three proposals to the Economic Development and Planning Council Committee on September 20. We will send this presentation to the City Council.
Staff will conduct an Open House on September 21 at the South Corridor Field Office (4:30 pm to 6:30 pm) for residents to review and comment on the proposals. Individual interviews will be held with each team in late September. Staff anticipates making a recommendation to the Economic Development and Planning Committee in October that would come to City Council in November.
