Attached is a revised legislative request from the Police and Fire Departments requesting changes in the designation of alternate members of the Civil Service Board.  We have attached a copy of the Civil Service Board's memo supporting the requested change for City Council's consideration.

The item will be added to the end of City Council's April 17 Zoning Agenda.

Duke Power has issued the final version of an Agreement-in-Principle (AIP) for approval by stakeholders who have participated in the Federal Energy Regulatory Commission (FERC) relicensing process for the past three years. Utilities has presented information about this process to City Council in January and in an update in the Council-Manager memo in February.

Utilities plans to approve the non-binding AIP on April 13. This document describes the results of the stakeholder process. The provisions described in the AIP will be included in a Final Agreement, which is the binding document that will obligate the signatories to specific actions for the term of the new FERC license.

Areas addressed in the Final Agreement will include:

  • Provisions for withdrawal of water from the reservoirs
  • Actions that water users will be required to take during drought conditions
  • Establishment of a Water Management Group to develop and fund initiatives to protect and preserve the water supply
  • Requirements for minimum lake levels
  • Actions by Duke to protect water quality, aquatic habitat, and wildlife; and
  • Contributions of land and funding by Duke to mitigate for environmental and other impacts caused by the formation and operation of the reservoirs along the Catawba River.

Utilities approval of the AIP means we agree to support its provisions and precludes our proposal or support of provisions that are not consistent with the AIP.

The Final Agreement, meanwhile, is scheduled to be issued on June 1, 2006, with the last date for approval being July 27, 2006. Utilities and the Attorney's Office are participating with Duke Power and a small group of stakeholders in the development of the Final Agreement. Utilities plans to brief City Council and request approval of the Final Agreement in late June or early July.

The Final Agreement will be submitted to the FERC with Duke's license application in August 2006. The FERC will consider inclusion of the Final Agreement provisions into the new license, which is not expected to be issued until at least 2008.
