The July 26 City Council agenda contains an item regarding the voluntary annexation petition for the Ballantyne YMCA property on Bryant Farms Road. The request is to (1) hold the required public hearing, and (2) adopt the annexation ordinance.
The annexation agreements that Charlotte has with the Mecklenburg Towns requires a 60-day notification of voluntary annexations prior to taking final action. On May 17, notification was sent to the Mayors of the six towns, but the Matthews notification was returned unopened late on the afternoon of July 22, with an "undeliverable: return to sender" message affixed by the post office. The 60-day notification obligation has therefore not been met for Matthews.
Our recommendation is that City Council still hold the public hearing at the July 26 meeting, but defer action on the petition until the September 27 meeting. This deferral will enable the Matthews notification to be received in accordance with the 60-day requirement.
