City staff is drafting a zoning ordinance text amendment to restrict the use of the innovative provisions of the MX and CC zoning classification by planned multi-family developments solely to become eligible for City roll-out garbage collection. This information was shared with you in Council Manager Memo #39 dated June 2, 2004.
At that time, staff was to bring a test amendment forward within 90 days to close the loophole. One development, Princeton at Southampton, recently changed its zoning classification using the current innovative provision and City roll-out service began on July 5. Continued use of this provision by planned multi-family developments could result in a significant unbudgeted financial and operational impact to Solid Waste Services.
In the last two weeks, another planned multi-family development has approached Planning staff to use the innovative provision for the same purpose. Staff would like to expedite the text amendment and is requesting that Council add the amendment for public hearing in September. This matter will be discussed with Council at the Monday night zoning dinner.
Agenda Item #1: 7th and McDowell Street Land Sale - Housing and Neighborhood Development Committee Recommendation

On July 13, 2004 the Housing and Neighborhood Development Committee met to receive the appraisal report for the City-owned land at 7th and McDowell streets. The Committee unanimously voted to recommend to City Council to proceed with the sale of the property to Centro-Drakeford, LLC for $2,142,630. Council will be asked to take action on the Committee's recommendation during the Zoning meeting on July 19, 2004

Agenda Item #2: South Corridor Light Rail Property Acquisition

At the June 28 meeting, the acquisition of the property at 5412 South Boulevard was deferred because of concerns with the notification process.
The property is being acquired for the South Corridor Light Rail Transit project.
The standard practice when requesting approval of a condemnation is to send the property owner a letter at least ten days in advance of the City Council meeting, advising that Council will consider the condemnation and that the property owner may address the Council.
The letter for the property at 5412 South Boulevard was prepared and sent less than 10 days prior to the June 28 City Council meeting. In addition, the letter was edited to inform the owner that he had seven days to respond to the offer. The owner received the letter only five days prior to the Council meeting.
Since June 28, staff has revised our internal processes to prevent this in the future, and the following steps have been taken to notify the owner of the South Boulevard property of the July 19 action:
- A letter was mailed, certified return receipt requested, on July 2 notifying the property owner of the new date for Council's consideration.
- The letter was received by the property owner on July 7
With notification now within normal standards, this property transaction has now been added to the July 19 Zoning agenda.
