Humane Society Restraining Order

On April 20, Superior Court Judge David Cayer placed the Humane Society of Charlotte under a temporary restraining order. Two of the Society's directors sought the order after they were voted off the board in a manner that was possibly in violation of the Society's bylaws.
The Humane Society's attorney will try to get the order overturned. Under the terms of the order, Catherine Tyler has been appointed as receiver to take over the society's day-to day operations until another hearing is held or for the next 10 days, whichever comes first.
Police Attorney John Joye has reviewed a draft of the restraining order. The order should have no effect on the Humane Society's ability to fulfill its spay/neuter contract with the City. It will mean that City staff will deal with Ms. Tyler, instead of Society President Patti Lewis, for the duration of the order. Staff will maintain contact with Ms. Tyler and work with her should any problems arise.
Access on Brookshire Boulevard (NC 16) Near Mt. Holly - Huntersville Road

Council members recently received a request from Edna Chirico to provide assistance in obtaining North Carolina Department of Transportation (NCDOT) and City approval of access on Brookshire Boulevard (NC 16) near Mt. Holly-Huntersville Road.
The access would be through one of two loop roads included in the Brookshire Boulevard/I-485 Small Area Plan adopted by City Council in January 2002. Ms. Chirico indicated that the developer would fund construction of the loop road associated with her client's project.
The Charlotte Department of Transportation staff is working with NCDOT's Division Engineer to evaluate the request and seek approval at NCDOT's May 15 Controlled Access Committee meeting. We will update you as these discussions advance.
Legislative Notebook

Included in the delivery today is the first-of-its-kind Legislative Notebook for use by the Mayor and City Council and key administrative staff. This notebook is an initial effort (to be improved over time) to capture key legislative initiatives by at least a dozen public and private entities in our area as well as a listing of contacts at the local, state, and national levels.
This is the first work product coming from discussions that originated with the Governmental Affairs Committee in January of this year. Updates of this notebook are planned twice each year. We welcome your feedback on how to improve this document as we prepare for the next long session of the Legislature in January 2005.
